Protections for Location Specific Plantation Produce

The Government has issued Regulation No. 31 of 2009 to provide protections to geographical regions that produce plantation products that are specific to that location. Generally, these protections will be afforded where the produce is not grown anywhere else as a result of specific regional factors such as human resources and knowledge, type and quality of soil, climate, systems used in the production process, and social economic factors, among others.

The protections are designed to maintain the quality and unique features of the produce of the particular region while simultaneously providing increased opportunities for improved income for the local community and ensuring long-term optimal production of the relevant produce.

The Minister is ultimately responsible for verifying the claims made by regions as to the uniqueness of their particular produce. This verification is to be done by survey. The survey will identify and evaluate the specific factors claimed. The Minister will appoint a Validation Team to undertake the verification process. The team will be appointed within ten days of the completed application being received.

The verification and validation process will take no longer than six months. Once the verification and validation is complete, the Minister is to issue either a validation agreement or a validation rejection to the applicant. The validation will remain valid for so long as the products meet the stipulated requirements.

The regulation imposes some basic obligations and prohibitions on the holders of a validation agreement. Simply, the obligations require that the holder undertake efforts to maintain and develop the unique produce. The prohibitions are equally simple and require that the holder not change the agreed terms for other purposes.

The regulation was issued on 24 March 2009 and has been in force since that date.
