A recent Presidential Instruction, No. 5 of 2005, on the Administration of the National Maritime Industry is intended to provide and establish an initial policy framework for the critical contributions that the maritime sector will continue to make. Indonesian maritime policy was essentially drafted more than 20 years ago and implementing regulations and other implementing instructions have been long overdue. This Presidential Instruction has taken more than 3 years to reach the enactment stage.
The Presidential Instruction (“Inpres”) is comprehensive, not so much in its content, but rather in its intent and the number of Departments that will be involved in administering and enforcing the provisions that it contains. The Inpres explicitly mandates the involvement of 13 Departments as well as Governors, Regents, and Mayors of all regions of Indonesia under the supervision of the Coordinating Minister for the Economy.
