The recent effort to centralize the bulk of business licensing operations in Integrated One Door Service Centers (‘PTSP’ Centers: See ILB No. 1133 2/7/2009) has caused a series of Ministries to issue regulations that delegate certain business licensing authorities to the Capital Investment Coordinating Board, or ‘BKPM’, which operates the licensing centers. In this case, the Minister of Forestry - by way of issuing Regulation No. P-01/MENHUT-II/2010 - has delegated certain forestry business licensing authorities to the Head of BKPM, which exercises the authority through PTSP Centers.
The delegation of licensing authority from the Ministry of Forestry to the Head of BKPM is strictly limited to the issuance of business forestry licenses for foreign investment purposes - as with other Ministerial delegations that have corresponded to the genesis of PTSP. The Attachment to this regulation lists the types of investment-related forestry activities whose licensing authorities are delegated to the Head of BKPM.
As with the other like-minded Ministerial delegations, the Head of BKPM must notify the Minister of Forestry about the issuance of every forestry business license, and must also submit an annual report that accounts for all licenses granted per year. Any licenses that are issued must consider and comply with the Negative Investments List (i.e., closed or conditionally-open business sectors), as well as licensing procedures required by the Minister of Forestry.
Although the same authorities were previously delegated to the Head of the BKPM under Minister of Forestry Decision No. 92/Kpts-II/1983, due to both organizational restructuring of state ministries and the inception of One Door Integrated Services, a new regulation was needed to accommodate the changes. To that extent, the 1983 Decision has been repealed and replaced by the 2010 Regulation. However, all business licenses issued prior to this regulation will remain valid until their expiry.
The regulation has been in force since 5 January 2010.
