Draft Implementing Regulation to the Job Creation Law: Control over Abandoned Areas and Lands

The government is currently preparing a Draft Regulation of the Government (Rancangan Peraturan Pemerintah – “RPP”) on the Control over Abandoned Areas and Lands dated 6 November 2020, in order to implement provisions set out under the following articles:[1]

1. Articles 27, 34 and 40 of Law No. 5 of 1960 on Basic Agrarian Regulations (“Agrarian Law”), which addressed the termination of land rights as a result of neglect; and
2. Article 180 of Law No. 11 of 2020 on Job Creation (“Job Creation Law”),[2] which addresses the revocation of rights, licenses and/or concessions in relation to lands and/or areas which are intentionally unutilized and/or neglected for a period of two years and which may therefore be stipulated as assets of the Land Bank.
