In 2019, the National Agency of Drug and Food Control (Badan Pengawas Obat dan Makanan – “BPOM”) introduced Regulation No. 12 of 2019 on Cosmetics Contamination (“Regulation 12/2019”). As its title suggests, this framework sets out a range of applicable safety and efficacy requirements for various substances that often unintentionally and unavoidably end up in cosmetics products as a result of processing, storage and/or that are carried over from the processing of the original raw materials (“Contamination”).[1]
However, in an effort to ensure that the applicable framework on Contamination thresholds is in line with current legal and technological requirements that apply within the cosmetics sector, BPOM has now decided to issue Regulation No. 16 of 2024 on Contamination Limits for Cosmetics Products (“Regulation 16/2024”), which is set to come into force on 18 September 2025.[2] Moreover, when Regulation 16/2024 is introduced on this date, the aforementioned framework of Regulation 12/2019 will be repealed and replaced.[3]
